These Terms and Conditions set out the basis on which Waste Clearance Chiswick provides waste collection and clearance services. By making a booking, using our website, or requesting any waste clearance service from us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, firm, or company who requests or purchases the waste clearance services.
Services means any waste collection, rubbish removal, recycling, loading, transport, or related service provided by Waste Clearance Chiswick.
Waste means any items, materials, rubbish, junk, or refuse agreed to be collected or removed by us.
Contract means the legally binding agreement between Waste Clearance Chiswick and the Customer for the provision of Services, incorporating these Terms and Conditions.
Waste Clearance Chiswick provides waste clearance, rubbish removal and associated services to domestic and commercial customers. The specific Services to be provided will be as described in the booking confirmation or written quote issued to the Customer.
Unless expressly stated, the Services do not include cleaning, repairs, dismantling of structures, or removal of fixtures and fittings permanently attached to a property. Any additional work requested outside the agreed scope may be subject to extra charges.
3.1 Booking request
The Customer may request a booking by telephone, email, or any contact method offered by Waste Clearance Chiswick. The Customer should provide accurate and complete information about the type and quantity of waste, access to the property, parking arrangements, and any special requirements.
3.2 Quotes and estimates
Any price provided in advance of collection is an estimate based on the information supplied by the Customer. The final price may differ if the volume, weight, type of waste, or access conditions vary from those described at the time of booking.
3.3 Booking confirmation
A booking is only considered confirmed once Waste Clearance Chiswick has accepted the request and provided a confirmation, which may be verbal, written, or electronic. We reserve the right to refuse any booking at our discretion.
3.4 Changes to bookings
If the Customer wishes to amend a booking, including the date, time, location, or scope of the Services, they must contact us as soon as reasonably possible. We will use reasonable efforts to accommodate changes but cannot guarantee availability or that the price will remain the same.
4.1 Access to premises
The Customer must ensure that Waste Clearance Chiswick and its employees or contractors have safe, adequate, and timely access to the premises for the duration of the Service. This includes arranging suitable parking, entry codes, keys, or permissions needed to carry out the work.
4.2 Preparation of waste
The Customer must ensure that the waste to be collected is clearly identified and separated from items not to be removed. If the Customer is not present, clear written or photographic instructions must be provided in advance.
4.3 Health and safety
The Customer must inform us of any known hazards at the property, including but not limited to asbestos, sharps, hazardous chemicals, infestations, or structural instability. We may refuse to handle waste or enter areas that present an unacceptable risk to health and safety.
4.4 Accurate information
The Customer warrants that all information provided regarding the waste and the premises is accurate and complete. Waste Clearance Chiswick is not responsible for delays, additional costs, or inability to perform the Services arising from incomplete or misleading information.
5.1 Pricing structure
Our charges are generally based on the volume and type of waste collected, the labour required, and any additional services agreed. Prices will be communicated to the Customer before or at the time of collection and confirmed before loading begins, where reasonably possible.
5.2 Payment terms
Unless otherwise agreed in writing, payment is due immediately on completion of the Services. We accept payment by cash, credit or debit card, or other methods notified to the Customer at the time of booking.
5.3 Late payment
Where credit terms have been agreed for business Customers, payment is due within the timeframe specified on the invoice. We reserve the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs incurred in pursuing late payment.
5.4 Non-payment
If payment is not made when due, Waste Clearance Chiswick may suspend further Services to the Customer and may, where legally permitted, recover any costs, expenses, and losses arising from non-payment, including legal costs and enforcement expenses.
6.1 Customer cancellations
The Customer may cancel or reschedule a booking by contacting us during normal business hours. We request at least 24 hours notice before the agreed arrival time. Cancellations made with less than 24 hours notice may be subject to a cancellation fee to cover costs incurred.
6.2 Our right to cancel
Waste Clearance Chiswick may cancel or reschedule a booking due to reasons including, but not limited to, vehicle breakdown, staff illness, extreme weather, unsafe site conditions, or circumstances beyond our reasonable control. In such cases, we will aim to notify the Customer as soon as possible and offer an alternative appointment where feasible.
6.3 Failed collections
If we attend the premises at the agreed time and are unable to carry out the Services due to the Customer’s failure to provide access, lack of parking, or other reasons within the Customer’s control, we may charge a call-out or wasted journey fee.
7.1 Prohibited waste
We may be unable to collect certain types of waste, including but not limited to asbestos, chemical waste, clinical waste, gas bottles, explosives, or any material classed as hazardous that we are not licensed or equipped to handle. The Customer must inform us in advance if such materials are present.
7.2 Hazardous or special waste
Where hazardous or special waste can be removed under appropriate licences and legal requirements, additional documentation, packaging, and charges may apply. Such arrangements must be agreed in writing before collection.
7.3 Ownership of waste
By presenting items for removal, the Customer confirms that they are the owner of the waste or have the owner’s authority to dispose of it. Ownership of the waste passes to Waste Clearance Chiswick upon loading into our vehicle, subject to legal obligations and compliance with waste regulations.
8.1 Duty of care
Waste Clearance Chiswick operates in accordance with applicable UK waste management laws and regulations. We will transport and dispose of waste using authorised facilities and methods, and will take reasonable steps to promote reuse and recycling where practicable.
8.2 Documentation
Where legally required, we will complete appropriate waste transfer documentation. Business Customers may be required to provide details necessary to complete such documentation and must retain copies of records to comply with their own duty of care obligations.
8.3 Environmental responsibility
We aim to minimise the environmental impact of our operations through efficient routing, responsible disposal, and promoting recycling and recovery of materials where possible. However, we do not guarantee that all waste will be recycled.
9.1 Our responsibility for loss or damage
Waste Clearance Chiswick will exercise reasonable care and skill in providing the Services. If we cause damage to the Customer’s property through our negligence, we may, at our option, repair the damage or compensate the Customer for reasonable losses directly resulting from that damage.
9.2 Exclusions of liability
We are not liable for any loss or damage arising from:
Items removed in accordance with the Customer’s instructions, including where the Customer later claims items were removed by mistake.
Pre-existing structural defects, wear and tear, or fragility of items or property.
Failure to perform, or delay in performing, the Services due to events beyond our reasonable control.
Any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of data.
9.3 Limitation of liability
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law. Subject to this, our total liability to the Customer for any claim arising out of or in connection with the Services shall not exceed the total price paid or payable for the specific Service giving rise to the claim.
9.4 Customer’s responsibility
The Customer is responsible for:
Ensuring that no valuable, sentimental, or important items are mixed with the waste to be removed.
Backing up or securing any data stored on items such as computers or electronic devices before disposal.
Obtaining any permissions or consents required from landlords, local authorities, or other third parties.
10.1 Reporting issues
If the Customer is dissatisfied with any aspect of the Services, they should notify Waste Clearance Chiswick as soon as possible, providing full details of the issue. We will investigate the complaint and aim to resolve it promptly and fairly.
10.2 Resolution
Where appropriate, we may offer to re-perform the Services, provide a partial refund, or take other reasonable steps to remedy the issue. Any remedy offered is without prejudice to our rights under these Terms and Conditions and applicable law.
11.1 Personal information
Waste Clearance Chiswick collects and processes personal data necessary to manage bookings, provide Services, and handle payments and communications. We will handle personal information in accordance with applicable data protection laws.
11.2 Use of data
Personal data may be used for administration, customer service, invoicing, record-keeping, and to improve our Services. We will not sell personal data to third parties. Information may be shared with trusted service providers, insurers, or authorities where required by law or necessary to provide the Services.
12.1 Our right to terminate
We may terminate the Contract or suspend the provision of Services immediately if the Customer:
Commits a serious or persistent breach of these Terms and Conditions.
Fails to pay any sum due on time.
Behaves abusively or illegally towards our staff or contractors.
12.2 Consequences of termination
On termination, any sums outstanding for Services already supplied become immediately payable. Termination does not affect rights and obligations that have accrued prior to the date of termination.
Waste Clearance Chiswick may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that Contract. It is the Customer’s responsibility to review the current Terms and Conditions when making a new booking.
These Terms and Conditions and any Contract between Waste Clearance Chiswick and the Customer are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with the Services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15.1 Entire agreement
These Terms and Conditions, together with any written quote or booking confirmation, constitute the entire agreement between the parties in relation to the Services and supersede any prior statements or representations, whether oral or written.
15.2 Severability
If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or competent authority, the remaining provisions shall remain in full force and effect.
15.3 Assignment
The Customer may not assign or transfer any of their rights or obligations under the Contract without our prior written consent. Waste Clearance Chiswick may assign or subcontract its rights and obligations where necessary to deliver the Services, provided that this does not reduce the level of service provided to the Customer.
15.4 No waiver
Failure or delay by Waste Clearance Chiswick in exercising any right or remedy under these Terms and Conditions shall not operate as a waiver of that right or remedy, nor shall any single or partial exercise prevent any further exercise of the same or another right or remedy.
